Abstract


The legal landscape in Indonesia pertaining to personal data protection is characterized by a scattered array of legal instruments, each adapting to specific aspects of the law without a comprehensive approach, resulting in suboptimal protection. This study aims to explore the utilization of artificial intelligence (AI) as a tool for safeguarding personal data and to underscore the pressing need for a specialized regulatory framework in Indonesia to address personal data protection concerns.

To achieve these objectives, a research methodology encompassing a statutory approach and a comparative legal approach is employed. The statutory approach involves analyzing the existing legal provisions related to personal data protection in Indonesia, while the comparative legal approach entails examining the practices and regulations in other jurisdictions known for their robust data protection frameworks.

The findings of this research highlight the immediate necessity for the Indonesian government to establish and ratify a dedicated legal instrument that specifically addresses the protection of personal data. Such legislation would provide a comprehensive framework to govern the collection, storage, processing, and sharing of personal data, ensuring adequate safeguards and remedies for individuals whose data is compromised.

Moreover, this study emphasizes the potential of AI in fortifying personal data protection measures. By harnessing the capabilities of AI technologies, the occurrence of human errors, which often lead to breaches and unauthorized disclosures of personal data, can be minimized. AI can enhance data security through advanced algorithms, anomaly detection, and automated monitoring, thereby bolstering the overall effectiveness of personal data protection efforts.

The integration of AI in personal data protection not only strengthens security measures but also contributes to a more efficient and reliable system. AI-powered technologies can analyze vast amounts of data in real-time, identify patterns and anomalies, and promptly respond to potential data breaches or unauthorized access, significantly reducing response times and enhancing incident management.

In conclusion, this study underscores the imperative for Indonesia to establish a specialized legal framework for personal data protection, and highlights the potential of AI as a powerful tool to enhance data security. The proposed legislation, coupled with the incorporation of AI technologies, would foster a more robust and comprehensive personal data protection regime in Indonesia, ensuring the privacy and rights of individuals in an increasingly data-driven society.
