Overview

The theme for The 4th International Conference on Law and Governance in Global Context (the 4th iCLave) is “Law and Challenges in New Normal: Challenges and Opportunities ". Post COVID-19 new normal period has brought up new horizon for law and governance especially in public health and medical services sectors. COVID-19 shook countries health system including question on Abortion which been a long heated political debate. Economic and trade decline due to COVID-19 has further increased number of joblessness, homelessness, and amount of poverty. This led to decreasing capacity of parents to bear babies. Thus, abortion may be a favorable exit.

 

Moreover, working from home trend also increases, based on data, pregnancy prevalence in Indonesia increases 96,7% in times of pandemic because of stay at home policy. Intensification and promotion of contraception method is the main solution by the government, however in several areas which did not have access to pregnancy contraception drugs and tech may select abortion as solution to eliminate pregnancy.

 

There are numbers of abortion method in Indonesia from traditional abortion using traditional herbs potion “jamu” to a traditional unsafe abortion technic performed by local shaman to a high-tech medical abortion performed by highly qualified specialist. These further challenges government to enact abortion control policies whether to allow or to ban abortion.

 

As a limited pro-life country, Indonesia only allows abortions under two conditions, first the pregnancy threaten mothers or babies’ life, second pregnancies because of rape also allowed to be aborted. Family capabilities and capacity to bear babies is not accounted. As a result, abortion may be selected to ease family burden. In the other hand if government allowed abortion under the circumstance to alleviate poverty it might raises question in what extent or degree of a people described not being able to bear a babies/child, as it may faces a lot of dilemmas.

 

Finally, law and policies cannot leave this issued unsewered, government should decide what policy is best for the societies. The absence of legal basis to solve this problem may also led to numbers of unsafe and illegal abortions.

The 4th International Conference on Law and Governance in a Global Context (icLave) 2022 is an event held by Faculty of Law, Universitas Indonesia (FHUI) that aims to provide an excellent international platform for the academicians, researchers and budding students around the world to share their research findings and to find international linkage for future collaborations in  the areas of Government policy-disparity between law in the book and law in society, Independent judiciary, Corruption eradication and asset recovery, Legal protection for women and children, Rule of Law and Constitutional Democracy, Law and the global labor market, Law and management problems in multinational corporation, Global investment governance, New developments in criminal law, penal law and criminal justice, Law, policy and conflict management on environmental and natural resources, Law and identities in blurred boundaries, Law and Intellectual Property Rights Protection, Protection to indigenous people/ local communities, The protection of individual identity and privacy at cyberspace, Competition Law and the monopoly of state-owned enterprises, Opportunities and challenges of ASEAN Economic Community, Global market penetration by micro, small and medium enterprises, Law, radicalism and terrorism, Climate change mitigation and adaptation, The development of family law and inheritance law in shaping future global communities, and Islamic finance and economic opportunities.

 

The Organizing Committee also encourage academics to submit cross-disciplinary research in the above areas.
